By using the website and availing of the services mentioned on the website, you agree to be bound by the Terms and Conditions mentioned herein.

This terms of use agreement (hereinafter referred to as the ‘Agreement’) along with the privacy policy governs the use of this website (https://tribaltoursandsafari.com or www.tribaltoursandsafari.com or tribaltoursandsafari.com) (hereinafter referred to as ‘the website’), by any visitor (hereinafter referred to as ‘you’ or ‘user’). The services and information offered on this website are available to you conditionally on your acceptance, without modification, of the terms enumerated in this terms of use agreement. If you disagree with any of the terms and conditions enlisted in this terms of use agreement, you must not use the website or avail of any of the services provided herein.

Tribal Tours and Safari reserves the right to change or revise these terms of use agreement on this website without prior notice. The changed/revised agreement shall be effective immediately after being posted on the website. Your use of the website after such revision or changes shall imply your acceptance of the changed/revised agreement.

This website offers information and marketing materials provided directly by us unless stated otherwise. The content provided by us on the website is the exclusive property of Tribal Tours and Safari and is protected by copyright, trademark, and other laws as applicable in India. You, hereby acknowledge the content to be the intellectual property of Tribal Tours and Safari and are restrained from copying, sharing, using, or modifying in any form without prior permission in writing from Tribal Tours and Safari.

TRIPS AND BOOKINGS

Tribal Tours and Safari, as part of its services, offers both pre-planned packages and custom trips to its guests. Tribal Tours and Safari does not guarantee the reliability, suitability, or punctuality of the services provided under the packages opted for by you through the website. The same can be subjected to adjustments and modifications depending upon circumstances, including but not limited to, natural calamities, road blockages, delayed arrivals, accidents, and other circumstances beyond the control of Tribal Tours and Safari. Any extra cost that may arise due to the above-mentioned circumstances shall be borne by the user alone.

It is the duty of the user to verify and confirm that the contents of the website and the packages provided on the website meet the specific requirements of the user. Furthermore, it is the duty of the user to verify the itinerary provided for the specific package or custom trip provided by Tribal Tours and Safari, including the Inclusions & Exclusions.

The packages availed by the user shall be confirmed only after the payment of the complete cost of the packages or as mutually agreed by Tribal Tours and Safari and the user over email from the official email id (ending with @tribaltoursandsafari.com) of Tribal Tours and Safari.

BOOKING AND PAYMENTS

For custom trips, if the start date of the trip is after more than a week, a booking amount of 50% is to be paid. The rest is to be paid at least one week before the start of the trip. Failure to pay the trip cost in full within the said time might result in the cancellation of the trip.

In the case of group trips, 100% of the trip fee is to be paid in order to confirm your slot in the group.

ITINERARY

Our tour itineraries, whether of group trips or of custom tours, are just an indication of what the tour is planned to accomplish and are not a contractual obligation on the part of the company.

CANCELLATION AND REFUND

If the user wishes to cancel any booking due to any reason whatsoever, the same shall be only valid if Tribal Tours and Safari is notified of the cancellation in writing on its official email id. In case of Cancellation and/or Refunds, the same will be done as per the Cancellation and Refund Policy of Tribal Tours and Safari. Refunds would be processed within 90 working days.

RESPONSIBILITY OF THE USER

It is the duty of the user to verify the dates and itinerary of his travels for the trips organized by Tribal Tours and Safari. If you have opted for a trip that involves trekking or any sort of physical activity, it is your responsibility to assess your fitness level and check the suitability of the adventure activity you wish to undertake.

Tribal Tours and Safari will not be responsible if the user finds the trek or the adventure activity to be beyond their physical and mental capabilities. If you suffer from any ailments and disabilities, that may hinder your enjoyment of the activity or which may pose risks when subjected to conditions during the adventure activity, it shall be your sole responsibility to get proper medical checkups and opinions. Furthermore, if any precautions or measures are to be undertaken for your health and safety it is the sole responsibility of the user alone.

Tribal Tours and Safari shall not be liable for any harm or damage that may befall you because of your inadequate physical, mental, and medical preparation for the adventure activity. While undertaking a trip, the luggage and personal effects are the sole responsibility of the user, and the user will carry them at their own risk.

When on the trip, the users are required to behave in a manner acceptable and conducive to group travel. The user shall refrain from acting in any manner which may be socially or morally unacceptable and which may cause annoyance or discomfort for fellow travelers or may endanger their life, person, or possession. Tribal Tours and Safari reserves the right to terminate the adventure activity, without refund, of any user who may act in the manner aforesaid mentioned.

DISCLAIMER AND WARRANTIES

Tribal Tours and Safari takes utmost care to make sure that the content and the services provided on the website are accurate, however, some inaccuracies or deficiencies in the content and the services may occur. The information and the packages provided on the website may be availed by the user at his own risk. Tribal Tours and Safari herein disclaims all warranties of any kind, express or implied, on the accuracy, veracity, and suitability of the information and the services provided on this website. You hereby acknowledge that the information and services provided on this website may contain inaccuracies, deficiencies, and/or errors.

LIMITATION OF LIABILITY

The extent of liability, and the extent of remedy, with respect to the contents of the website and the services provided herein, or any breach of the agreement shall be limited to the extent of the amount paid by the user for the information or service provided. To the extent of contents and information that is provided free of charge on this website, Tribal Tours and Safari will not be liable for any loss or damage arising out of that.

Tribal Tours and Safari shall not be liable for any loss or damage arising directly or incidentally from the use of the website, its contents, or the packages provided on the website, or any loss suffered by the user in payments made through the website.

It is imperative that the user assent to the participation form/waiver of rights/indemnity bond by affixing their signature before undertaking the adventure activity provided through this website by Tribal Tours and Safari. Tribal Tours and Safari reserves the right to refuse the user from participation in the adventure activity if the user refuses to assent to the participation form/waiver of rights/indemnity bond, and Tribal Tours and Safari shall not be liable to make any refund for the same.

DISPUTES AND JURISDICTION

Any disputes arising shall be subject to Mon, Nagaland, India jurisdiction.

CHANGES TO TERMS

We (Tribal Tours and Safari) may, at any time, and at our sole discretion, modify these Terms and Conditions of Use, including our Privacy Policy, and cookie policy, with or without notice to the User. Any such modification will be effective immediately upon public posting. Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified terms.

INDEMNITY

You hereby release, indemnify and hold harmless Tribal Tours and Safari and any of its owners, partners, and agents from all liability claims, damages, costs, and expenses, arising from breach of any obligations or warranties provided under this agreement, or from the use of the information, services, and packages provided on the website or custom packages provided to you by Tribal Tours and Safari.

UNCERTAINTIES AT THE TIME OF COVID-2019 / DUE TO NATURAL CALAMITIES / PROTESTS / STRIKES

While we will keep you updated as things change on the ground, once you have confirmed your trip with us, any unexpected delays or closure or the introduction of new SOPs or restrictions in any form are totally out of our control so we will not be responsible for the same.

In case of any other unexpected events as mentioned above, while Tribal Tours and Safari will do their best to ensure the safety and comfort of the guest, in the given situation, any necessary additional expenses that might have to be incurred, will not be the responsibility of Tribal Tours and Safari, and will have to be borne by the guests.

TO TRAVEL WITH US, YOU WILL HAVE TO BE:

• Fully vaccinated for COVID (Both doses)

• Partially vaccinated for COVID (1 dose) and should possess an RTPCR -ve test report for COVID that is not older than 72 hours at the time of entry to the start of the tour.

Any additional govt. regulations of the states where you are traveling will apply, as applicable.

Any tours booked by guests who do not fall in the above-mentioned points will be canceled automatically without any refunds.

Cancellations And Refunds

We know that no one likes to simply cancel a trip they have booked and have been looking forward to. We swear we would never do that and we are sure, neither would you unless something unexpected comes up. And when you have to cancel a trip [ie, when you are already pissed-off], the last thing you would need is a confusing or complex cancellation & refund policy.

So we have tried to keep it very simple. This is how it goes.

For Fixed Departure Tours

50% refund if canceled up to 45 days before the start of the trip.

25% refund if canceled between 44 and 30 days before the start of the trip.

No refund if canceled within 30 days from the start of the trip.

No refund if you have to leave a trip in the middle.

For Custom Trips

70% refund if canceled up to 45 days before the start of the trip.

50% refund if canceled up to 44-31 days before the start of the trip.

No refund if canceled within 29 days from the start of the trip.

No refund if you have to leave a trip in the middle.

The GST component of the trip cost is NOT refunded.

If a particular trip has its own Cancellation and Refund Policy (Group Trips only) attached to it, then THAT policy will be applicable for the trip in question. The policy above is only applicable if a trip has no Cancellation and Refund Policy attached to it.

Rescheduling charges will be the same as the Cancellation charges, as mentioned above. However, rescheduling is purely based on availability on the newly requested dates.

In case a trip gets canceled due to any unforeseen or unavoidable situation around your travel dates [strikes, natural disasters, or something similar] beyond our control, we will do our best to re-schedule your trip to some other date to your liking. If you are on a tight schedule and a change of dates does not work for you while booking, we will give you a credit shell of the full trip cost which can be used to book another trip of your liking within the next 365 days.

Any cancellation or rescheduling requests due to personal reasons would incur charges as mentioned above.

Cancellation Due To COVID nation-wide/region-wide situation

** If there are any unexpected changes on the ground as a result or related to the COVID – 2019 pandemic and your trip gets canceled, you will be eligible for a free rescheduling of your trip within a period of one year or until things on the ground change and tourism resumes again, whichever is later. You can also transfer your credit shell amount to a friend or family if you feel you will not be able to come down for the trip. In case any expense such as govt. permits etc. have already been incurred and are non-refundable in nature, that cost will be passed on to the guest.

Sadly, the GST cannot be refunded for any canceled trips.

Any non-refundable costs like govt. permits, etc. that might have already been incurred will also not be refunded/adjusted in the credit shell. The credit shell cannot be converted into cash or refunded. You can always transfer your credit shell to your friends or family.
